Cdifit Cloud Drive User Service Agreement
This agreement is jointly entered into by you (hereinafter referred to as the "User" or "You") and the operator of Cdifit Cloud Drive, ByUsi (hereinafter referred to as the "Operator" or "We").
Please read carefully and fully understand the terms of this agreement, especially those highlighted in bold. Your registration, login, viewing, use, and other actions regarding this service will be deemed as your reading and acceptance of this agreement.
Article 1 Service Definition
- Cdifit Cloud Drive is an internet technology platform operated by ByUsi, providing users with services such as network data storage, synchronization, management, and sharing.
- The core storage infrastructure of this service is provided by third-party cloud service providers domestically and internationally (including but not limited to Microsoft's Azure services and Alibaba Group's Object Storage Service OSS). User data files are ultimately physically stored on servers of the aforementioned third-party service providers.
Article 2 Service Fees
- This service is a commercial paid service and is not a public welfare or free product. You understand and agree that you must pay service fees according to the fee standards we publish to use the corresponding service functions. We reserve the right to set and adjust fee standards and charging methods, and will notify you through one or more methods such as official website announcements or system notifications before implementation.
- Payment Channel Statement: This service offers AFDIAN (爱发电) as an optional payment channel. When you make payments through the AFDIAN platform, you are also required to comply with AFDIAN's relevant agreements and rules. Any payment actions and potential disputes arising between you and the AFDIAN platform shall be resolved by you and AFDIAN independently. The Operator assumes no responsibility related to this payment channel but will make reasonable efforts to coordinate to ensure you receive the purchased service.
Article 3 Account Registration and Login
- Microsoft Account Login: This service supports using a Microsoft account for quick registration and login. When you choose to log in with a Microsoft account, you authorize us to create or associate your Cdifit Cloud Drive account based on Microsoft's verification results. The information you provide to Microsoft during this process is governed by Microsoft's privacy policy and terms of service.
- Account Security: You are responsible for safeguarding your login credentials (whether it's your Cdifit account password or third-party account credentials) and for all activities conducted through that account. The Operator will not and cannot obtain your account password from Microsoft through this process.
Article 4 User Behavior Standards and Content Compliance
- Legality Commitment: You promise and guarantee that all data, files, links, and other content (hereinafter referred to as "User Content") that you upload, store, manage, or share using this service comply with the laws, regulations, departmental rules, policies, and public order and good customs of the People's Republic of China. You are strictly prohibited from producing, copying, publishing, or disseminating information content prohibited by laws and administrative regulations.
- Content Management Mechanism
- Private Files: The Operator respects user privacy. For private files that you have not shared in any form and are only stored in your personal account space, the Operator does not conduct proactive or universal content review.
- Third-Party Review Notification and Disclaimer: You fully acknowledge and understand that since the underlying storage service is provided by third parties, these third-party service providers may monitor and review all content stored on their platforms based on their own service agreements, usage policies, or the laws and regulations of their locations, and independently decide to take measures such as blocking, deletion, or denying access without prior notice to the Operator or you. Such actions are entirely beyond the Operator's control. The Operator shall not be liable for any consequences arising from third-party service providers' review, deletion, or other actions regarding your files, including but not limited to file loss, service interruption, data damage, etc.
- Operator's Review and Disposal of Shared Content: The Operator has the right to review any shared content (whether public or private) that you create through this service for compliance purposes. Once shared content is found to violate Article 4.1 of this agreement, the Operator has the right to take the following escalating measures based on the severity of the violation, without any liability:
- First Violation: The Operator will send an inquiry notice to the contact email provided during your account registration, requiring you to provide an explanation within 【3】 business days. If you fail to respond within the time limit or your explanation is deemed invalid, the Operator has the right to immediately delete the violating shared link and the corresponding stored file.
- Second Violation: The Operator has the right to suspend your account usage rights for a period of 【7】 days. During the suspension, you will be unable to access and use this service.
Article 5 Operator's Disclaimer
- Third-Party Action Disclaimer: You explicitly understand and agree that the Operator shall not be liable for any disputes or consequences arising from third-party cloud service providers (including but not limited to Microsoft, Alibaba Cloud) deleting, blocking, or taking other actions against your files based on their own policies, and has no obligation to communicate, appeal, or claim on your behalf to such third parties. You should independently understand and comply with the relevant policies of third-party service providers.
- The Operator shall not be liable for service interruptions, data loss, or other defects caused by force majeure (such as earthquakes, fires, wars, network attacks, technical adjustments by telecommunications departments, etc.), computer viruses, hacker attacks, government controls, or other reasons not attributable to the Operator, but will strive to minimize losses and impacts caused to you.
Article 6 Agreement Modification and Termination
- The Operator has the right to modify any terms of this agreement at any time. The modified agreement will take effect after being published on the official website or client of this service. If you do not agree to the modified agreement, you have the right to stop using this service; if you continue to use it, it will be deemed that you accept the modified agreement.
- For users who violate this agreement, especially those with multiple violations of sharing behavior, the Operator has the right to unilaterally terminate the provision of this service, permanently ban their accounts, and reserve the right to pursue legal liability.
Article 7 Governing Law and Dispute Resolution
- The conclusion, execution, interpretation, and dispute resolution of this agreement shall be governed by the laws of the People's Republic of China.
- If any dispute arises between the parties regarding the content or execution of this agreement, the parties shall first attempt to resolve it through friendly negotiation; if negotiation fails, either party has the right to submit the dispute to the competent people's court in the location of the Operator for litigation resolution.
